[TRANS] Netizens Apologize To Crebeau


Since the beginning of the lawsuit, a flock of so-called fans have gathered at a website called ‘Daum Television TVXQ Gallery’. These fans ally themselves with SM Entertainment, defaming the trio and causing hatred amongst fans. One of the most frequently raised issues revolves around a cosmetics company, and criticisms on the trio are translated into Japanese, English and Chinese, and posted onto various websites.

‘Daum Television TVXQ Gallery’ was one of the three websites involved in the initiation of the recent pro-SM fan petition (the other two being ‘savetvxq’ and ‘aftertvxq’). The petition requests a formal apology as well as the three members’ return to SM Entertainment.

The fans on these websites contend that the lawsuit filed by the three TVXQ members was ‘based off of momnetary temptation which began with the cosmetic company.’ They also viciously accuse Crebeau cosmetics of selling cheap, second-rate ‘made in china’ products, and publicly critisize the company for running a pyramid scheme.

The same allegations were made by SM in a press conference held last year.

The slander and defamation of SM and these so-called fans have caused Crebeau Cosmetics severe losses, and this triggered Crebeau CEO Kang Seok Won’s lawsuit against SM CEO Kim Young Min, in which the former claimed victory (NOTE: This is not true, the police finished investigation for the lawsuit and passed the documents on to the Seoul Central District Prosecutor’s Office. Crebeau did NOT win the lawsuit).

Recently, having gathered sufficient evidence of slander against them over the internet, Crebeau pressed charges against a total of 15 netizens involved in the dissemination of defamatory rumours.

The individuals who have been pressed charges against have since posted letters of apology over various websites.

Below are apologies from three of the ‘Daum Television TVXQ Gallery’ members.

To all employees of Crebeau Cosmetics Company,

To all the employees of Crebeau whom I have harmed with the contents of my blog, please accept my sincere apologies.
All of this is the consequence of my thoughtlessness, my fallibility and what I thought to be my love for TVXQ.
In particular, I’d like to apologize to President Kang for the extensive losses and pain I have caused. Sorry.

When I wrote the piece about Crebeau, I was expressing my personal opinion and my perception of ‘the truth’, I did not consider the possibility that what I was writing could be completely false, I am truly sorry.
In my naivety, I only thought of myself and failed to consider the staff of Crebeau, I am very sorry.

I am writing this to convey my remorse for the damage I have caused to your company’s reputation. Because of my mistake, many people formed a negative impression of Crebeau.

I have finally come to realize that the things we wrote were the weapons contributing to Crebeau’s losses, I am very regretful.
Looking back at what I wrote, I was rude and disrespectful.
From a young age, my parents taught me the importance of courtesy, of respect, and at that moment, I threw all of it away. To date, everything I have written has been an expression of my own feelings.
I’d like to apologize once again for the things I have written.

I will delete all of the pieces in question and accept all of the charges issued against me.
I am sorry for the damage I have caused with my reckless behaviour, and I will not write anything related to Crebeau Cosmetics in the future. I will leave this website, and this letter of apology will also be the last that I post here.

Once again, I apologize for the harm I have inflicted on all members of staff.
Please take into consideration my young age and the fact that the problem lies with me immaturity. Forgive me.

Finally, I sincerely apologize for this event.

[TRANS] 100416 China Court: “TVXQ Has Nothing To Do With The Cosmetics Company Promotion”


SM Entertainment had attributed the main reason for the “TVXQ’s Lawsuit” to be the cosmetics investment business by some of the TVXQ’s members and used this reason as justification to propose a 2.2 billion won in damages from the 3 members.

The declaration that SM Entertainment had submitted to Seoul Central District Court on 14th April claimed that “Some TVXQ members had invested in a cosmetic company which resulted to be the beginning of the conflict. They have used TVXQ’s name and portrait without the company’s consent and that have violated the exclusive contract. However, they denied the effectiveness of the exclusive contract and proposed the disposition for the effectiveness of the termination of the exclusive contract”. During November last year, China Beijing Kowloon Station Century Culture Communication Co. Ltd* (Gao Jian Wen, Representative. Also known as Beijing Kowloon Station Inc.) had used “The fraud of Crebeau which is the collaboration between TVXQ’s 3 members and Korea Cosmetics Company, Wisyaplus had caused their damages” as the reason to apply for legal action for the damages compensation at the District Court. Recently, the cosmetics company, Wisyaplus announced that “Beijing Haidian District People’s Court rejected the Beijing Kowloon Station Inc’s claims” and revealed the China Court’s arbitration decision documents.

According to the open verdict, the court had rejected all the arbitration applications from the applicant (Beijing Kowloon Station Inc.) and the applicant will bear all the costs for the arbitration (38,470 yuan = 5,635 USD). TVXQ’s 3 members has nothing to do with the cosmetics company promotion and this was ultimately confirmed by the China Court. And SM Entertainment have been using the photos of the 3 members attending the investment seminars to suspect if the 3 members had directly or indirectly carry out promotional activities.

On the other hand, the cosmetic company’s representative, President Kang Suk-won had expressed towards the accusation of SM Entertainment attributing the main cause of the TVXQ’s lawsuit with the members’ cosmetics business that “The police investigation has already shown that the reason behind the TVXQ’s lawsuit has nothing to do with the cosmetics. However, SM Entertainment once again entangled with it. Therefore, our company will propose a reputation damage lawsuit again for the third time”.

President Kang Suk-won claimed that “The reasons why TVXQ’s 3 members had filed a lawsuit towards SM Entertainment are because of the unfair contractual relationship and unjust distribution of income distribution. This fact has been ruling in the injunction application and it was confirmed. However, such behaviour seems to have become a kind of inertia for SM Entertainment in order to rescue its company reputation”.

Wisyaplus had already filed the reputation damage and impede business lawsuit towards SM Entertainment twice in August and November last year. Seoul Gangnam Police Department investigation ended in February and make the decision of without detention and transfer investigation towards SM Entertainment representative, Kim Youngmin. At that point of time, the police had already made a judgement that “The lawsuit of ending the long term exclusive contracts requested by TVXQ’s 3 members had nothing to do with the cosmetics investment”.

[NEWS] 091104 CreBeau Speaks Out in TVXQ Issue


It seems we finally have word from the company that seems to be tangled in this mess.

When the TVXQ / DBSK / Tohoshinki controversy first began, the three members and their lawyers clearly stated that the three members’ investments in the CreBeau cosmetics line did not have any relevance to the court case. The core of the controversy was the legal issues of the slave contract. In SM Entertainment’s opening statement, they stated that the lawsuit was because of the cosmetics issue.

To clear up the confusion, Kang Suk Won, the President of the Korean branch of CreBeau (Wishop Plus) was interviewed. Kang has already sued SME’s CEO Kim Young Min for slander to the Seoul Central Court on October 4th, 2009.

Kang said, “Although this case is obviously to fight the unfair profit splits and the conflict between the members and SME, SME is trying to push the blame onto CreBeau.”

Kang went on to reveal that the three members have only invested approximately 70,000 dollars, 60,000 dollars, and 40,000 dollars respectively. This amount, he said, was not enough to earn the three members rights to ownership of the business, let alone a big part of the profit.

Kang said, “In May 2009, some SME representatives visited the original branch of CreBeau Cosmetics in China twice. They determined that the members were not going against contract terms in any way, and now SME is distorting the true reason behind the case and putting out ridiculous claims… SME said that the whole lawsuit was due to the members’ wanting to continue a business that went against contract terms. This has no credibility in that SME has already approved of the investments previously. The members wouldn’t risk all the things that they gained as TVXQ by creating a conflict with their company over insignificant investments. It was a private investment, and the three have no ownership over the business in any way. They’re merely investors, nothing less, nothing more. What does this have to do with the lawsuit, and why is SME attempting to connect the two together?”

Kang went on to say that SME’s actions have brought about significant harm to the business not only in Korea, but all over Asia, including China, Japan, Hong Kong, Taiwan, Vietnam, and even the United States. For the employees and CEOs all over the world, CreBeau is their sole income. SME should have considered the impact its blames would bring to the business and the people involved in it.

“If SME’s company and its profits are so important that they are willing to harm others for it, then SME should recognize that it is the same for others.” Kang went on to say that “If SME does not stop distorting the truth and doesn’t apologize for the harms it brought upon CreBeau, I will not hesitate to reveal the details of SME’s absurd act to the public and to the court.”
